1. ACKNOWLEDGMENT OF RISK

I understand that participation in martial arts activities, including but not limited to Brazilian Jiu Jitsu, Judo, Kickboxing, and Mixed Martial Arts (MMA), involves inherent risks. These risks include, but are not limited to:

Physical injury (minor to severe)

Sprains, strains, fractures, and dislocations

Cuts, bruises, and abrasions

Head injuries, including concussions

Loss of consciousness

Permanent disability or death

I acknowledge that these activities involve close physical contact, throws, joint locks, strikes, and submissions that may result in injury even when performed correctly.

2. ASSUMPTION OF RISK

I voluntarily choose to participate (or allow my child to participate) in these activities and knowingly assume all risks, both known and unknown, associated with participation.

I certify that I (or my child) am physically fit to participate and have no medical conditions that would prevent safe participation. I agree to inform instructors of any injuries or medical concerns prior to training.

3. RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless El Dorado Jiu Jitsu and Judo ("The Forge"), its owners, instructors, staff, volunteers, members, and affiliates from any and all liability, claims, demands, or causes of action arising out of or related to any injury, disability, death, or loss or damage to person or property resulting from participation in gym activities.

This includes, but is not limited to, claims arising from negligence of the gym or its representatives.

4. RULES AND CONDUCT

I agree to follow all gym rules, instructions, and safety guidelines provided by instructors and staff. I understand that failure to follow rules may result in injury to myself or others and may result in removal from training.

5. MEDICAL CONSENT

In the event of an injury or medical emergency, I authorize the gym and its representatives to obtain medical treatment for me (or my child). I understand that I am responsible for any medical expenses incurred.

6. PHOTO AND VIDEO RELEASE

I grant permission for the gym to use photographs or videos of me (or my child) taken during training for promotional and marketing purposes, unless I provide written notice opting out.

7. MINOR PARTICIPANTS

If the participant is under the age of 18, I certify that I am the parent or legal guardian and have the authority to sign this agreement. I agree to all terms on behalf of the minor and accept full responsibility for their participation.

8. GOVERNING LAW

This agreement shall be governed by and construed in accordance with the laws of the State of Arkansas.

9. SEVERABILITY

If any portion of this agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

This MEMBERSHIP AGREEMENT is entered into on {start_date}, by and between El Dorado Jiu-jitsu and Judo, and {name}.

1. Binding Agreement : This Agreement sets forth the terms and conditions under which the Member shall have access to martial arts instruction and classes provided by El Dorado Jiu-jitsu and Judo. By signing below, Member agrees to be bound by all the terms and conditions set forth in this Agreement.

2. Term: Unless earlier terminated in accordance with Section 3, after the Initial Term, this Agreement shall continue in effect on a month-to-month basis (each, a “Subsequent Monthly Term”) until 30 days after Member delivers written notice of termination to El Dorado Jiu-jitsu and Judo. The initial term will be pro-rated at a daily amount beginning on the effective date and ending on the last day of the month. Each Subsequent Monthly Term shall begin on the first day of each month and end at the close of business on the last day of each month.

3. Termination: This Agreement may be terminated by the School (i) at any time if Member breaches this Agreement. This Agreement may be terminated by Member (or Member’s estate) by delivering written notice of termination to El Dorado Jiu-jitsu and Judo.

4. Pricing: El Dorado Jiu-jitsu and Judo offers an Adult Unlimited Membership for a price of $120 per month, and a Kids Unlimited Membership for a price of $90 per month. El Dorado Jiu-jitsu and Judo offers a 10% First Responder Discount for active/reserve/national guard military members, law enforcement, and Paramedics/EMTs. El Dorado Jiu-jitsu and Judo offers a family discount which applies to direct family members of the same household only. The family discount applies a 15% discount to the 3^rd member of direct family within the same household, and a 25% discount to the 4^th member of direct family within the same household. One adult family member MUST pay the full monthly price.

5. Payment: As of the Effective Date, Member has paid to El Dorado Jiu-jitsu and Judo the entirety of the monthly payment, which covers the period beginning on the Effective Date and ending the last day of the Initial Term. Prior to the 5^th day day of each subsequent month, the member will satisfy payment and hereby authorizes and directs El Dorado Jiu-jitsu and Judo or its agents to charge the payment to the Member automatically through a recurring ACH, Debit, or Credit transaction.

6. Instruction: Member’s ability to attend classes and receive instruction at El Dorado Jiu-jitsu and Judo each month is conditioned on El Dorado Jiu-jitsu and Judo’s receipt of the payment for such month. El Dorado Jiu-jitsu and Judo shall have the right to suspend Member’s membership at any time and from time to time during any period that Member is not current in the Payment. All instruction shall be offered at such times as determined by El Dorado Jiu-jitsu and Judo in its sole discretion. El Dorado Jiu-jitsu and Judo reserves the right to change its class schedule or the frequency thereof at any time and from time to time without advance notice to the Member.

7. Policies and Rules: Member hereby acknowledges that the Member has read and understands El Dorado Jiu-jitsu and Judo’s rules. The Member further acknowledges that El Dorado Jiu-jitsu and Judo has the right to change the School Rules at any time and for any reason. The Member hereby agrees to comply with and be bound by the School Rules, as the same may be amended from time to time.

Rules:

1) Be respectful of everyone, at all times.

2) No profanity, trash talk, locker room talk, or negative attitudes allowed.

3) Keep fingernails and toenails trimmed.

4) Practice good hygiene.

5) If you are sick or have any type of potential skin infection, stay home.

6) Keep uniforms (gi and no gi) clean.

7) Train with control, not recklessness. You're responsible for your training partner's safety.

8) No shoes on the mat. Cell phones either.

9) No coaching unless you're asked to by an instructor, especially parents. Encourage all you want, but don't coach. If you would like to be a coach, sign up and train! Then we can talk about you becoming a coach. Let the instructors do the coaching.

10) Clean up after yourself. You are responsible for your (and your kids') clothing, equipment, trash, and messes.

8. Representation of the School. Member agrees that Member shall not, without the prior written consent of El Dorado Jiu-jitsu and Judo, hold himself or herself out publicly as representing El Dorado Jiu-jitsu and Judo in any manner, including, but not limited to, as a professional or amateur fighter, in martial arts or other combat tournaments, etc.
